Bail Bond Information

Helpful answers for families looking for quick bail bond guidance.

What is bail?

Bail is money paid to the court to ensure that an arrested person who is released from jail will show up at all required court appearances.

Who is a co-signer or guarantor?

A co-signer or guarantor is the person willing to be responsible for the defendant while the defendant is out on bail and who co-assumes financial responsibility, including guaranteeing the full bail bond amount.

When does a forfeiture take place?

A forfeiture occurs when a defendant fails to appear in court. If a defendant misses a court date, a bench warrant may be issued. In some cases, the bond may be reinstated when the defendant reports back to court.

What is a reinstatement?

A reinstatement is a process where a defendant who failed to appear may have the bench warrant removed and the bail bond reactivated by reporting back to court. Additional fees may apply.

Is the premium refundable?

The premium is generally earned when the defendant is released from custody and is not subject to return, even if the defendant is found innocent, the case is dismissed, or the defendant is later taken back into custody.

Who can post bail for me?

You may post bail for yourself, have someone over 18 post bail on your behalf, or use a professional bail bondsman. The person posting bail assumes responsibility for your appearance in court.

What does exoneration mean?

A bail bond is exonerated when the legal process has finished and the bond is discharged. Any unpaid premium, fees, or other amounts owed to the bail service provider may still remain due.

How can I post bail?

Common options include cash bail, property bail, certain intangible assets, credit or debit card payments where accepted, or using a professional bail bondsman who charges a non-refundable fee to post bail.
